Lipitor Lawsuits

Lawsuits are currently being filed against the manufacturer of Lipitor due to the fact that women taking Lipitor have experienced negative side effects, such as type two diabetes. The attorneys at the Robichaux Law Firm are currently accepting Lipitor cases nationwide. Our law firm provides information regarding Lipitor legal issues.

Side Effects of Lipitor

Lipitor helps reduce cholesterol, but like most prescription drugs, Lipitor may cause certain side effects. Some side effects are mild, but others can be dangerous and cause serious injury and permanent damage. For example, women taking Lipitor may have an increased risk of developing diabetes. Recent studies suggest that women who are taking Lipitor to reduce cholesterol are at a greater risk of developing type-2 diabetes, particularly if they are postmenopausal. Side effects associated with Lipitor may include:

  • Indigestion
  • Constipation
  • Gas
  • Diarrhea
  • Headache
  • Dizziness
  • Nausea
  • Liver problems
  • Intestinal Ulcers
  • Kidney Stones
  • UTI
  • Type-2 Diabetes

The manufacturer of Lipitor did not warn patients of the risk of developing type-2 diabetes when taking this drug. In 2012, the U.S. Food and Drug Administration (FDA) concluded that Lipitor can adversely affect patients by increasing serum glucose levels, which can cause diabetes. Based on the information contained in these clinical trials, the FDA requested that the manufacturer of Lipitor amend the drug label to address this potential risk.

If you experienced a negative side effect when taking Lipitor or any other prescription drugs, you should report it to the FDA. Visit www.fda.gov/medwatch for more information.

About Lipitor

Lipitor (atorvastatin calcium) is a prescription medicine that comes in tablet form. Lipitor is a statin, which is a type of cholesterol lowering medicine. Statins work by blocking an enzyme in the liver that makes cholesterol. This reduces overall cholesterol levels in the body.

Doctors prescribe Lipitor for patients with high cholesterol who are at risk of getting heart disease, which could lead to high blood pressure, heart attack and/or stroke. Lipitor is a commonly prescribed drug for reducing cholesterol. Over 20 million patients have been prescribed Lipitor. Lipitor® is manufactured by Pfizer, Inc.

Is there a Lipitor Class Action or MDL?

While numerous Lipitor cases have been filed and continue to be filed, there is currently no class action for Lipitor side effects. Instead of creating a class action lawsuit, plaintiff lawyers have filed a motion to consolidate all federal Lipitor cases with similar claims into an MDL (multi district litigation).

MDLs are similar to class actions, in that, if instituted, all cases will be tried in front of the same judge in the same district court. However, MDL cases are tried on an individual basis. Each case will have a separate trial, as opposed to class action lawsuits, where all plaintiffs’ claims are represented in one case. In class action lawsuits, all the plaintiffs split a single award and the compensation each plaintiff receives is not in any way reflective of each plaintiff’s actual damages. Since MDL lawsuits are tried separately, there is a greater likelihood of plaintiffs in an MDL receiving adequate compensation for their injuries than in a class action suit.

Due to an increased number of lawsuits pending against the maker of Lipitor, Pfizer, the plaintiffs have moved to coordinate the cases to multidistrict litigation. Although the location of the Lipitor MDL has not yet been determined, one such possible jurisdiction is the New Orleans, Louisiana. The U.S. Judicial Panel on Multidistrict Litigation announced that oral arguments for selected Lipitor lawsuits will begin on Jan. 30, 2014. At this hearing, the court will review 56 lawsuits pending in federal courts throughout the nation that allege Lipitor side effects caused women to develop type-2 diabetes.
